DESCRIPTION OF THE SERVICE

Boulevard NetStep is a free system that makes running an internet cafe easier by managing time, billing, security.

WHAT TO EXPECT IN THE FUTURE

Boulevard will update and change the system in the future as we see fit, when this happens the NetStep application will automatically update itself. Some updates we are planning for the near future are:

- Global Accounts

This will allow you to set your customers up with prepaid accounts that then can be used at any location running the full Boulevard network system. It will also mean that roaming global account holders will be able to use their accounts at your location. There is likely be a transaction fee on account transactions.

- Advertising

Advertising will be the main way the system is funded and income is generated. For a fee locations could opt not to receive advertising.

MODIFICATIONS TO SERVICE

Boulevard reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Boulevard shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

AUTOMATIC VERSION UPDATING

Because it is a network application it is important the all locations are running the same and latest versions. We achieve this by running an updater on startup. When the system is started the updater checks the version on your PC with the version on the download site. If there is a newer version it is automatically downloaded and replaces the old version. The new version is used the next time you start the application.

REGISTRATION IS PER LOCATION

Due to the need to keep session information under a location ID, an  ID is ONLY for, and can ONLY be used in one location. If you have two locations you must register the second location and get a second ID.

REGISTRATION PROTECTION IS WEB SERVER BASED

Because of the need to prevent IDs being used in multiple locations, the Boulevard NetStep application contains advanced copyright protection. Attempts to modify NetStep, use an invalid registration code, or attempts to circumvent the copy protection can cause NetStep to stop functioning. In addition, such illegal activities may prevent the user from using NetStep or any future Boulevard products.

CONTACT INFORMATION AND SESSION STATISTICS

Your registration details and daily session information are held on secure internet web servers in an account under your location ID. An account is created and registration information placed in it when you register. Session information is sent from the NetStep manager to the web server at the end of each session.

This site has security measures in place to protect the loss, misuse and alteration of the information under our control. Accounts are protected by a user ID and password. Passwords are encrypted in the database and during transfer through the internet. In the case of forgotten passwords proof of identity (like the answer to a hint question, and demographic information) must be provided to be able to change the password. All user data and systems are backed up daily, a second server provides login redundancy.

ID AND PASSWORD SECURITY

You will receive a password and account designation upon completing the registration process. You are responsible for maintaining the confidentiality of the password and account. You agree to (a) immediately notify Boulevard of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Boulevard cannot and will not be liable for any loss or damage arising from your failure to comply with this.

DISTRIBUTION / NO RESALE

The NetStep application may be freely distributed, however new locations must register at NetStep.co.nz to get a key to start the system. You must include all files included in the distribution package.  You are specifically prohibited from charging, or requesting donations, for any such copies, however made, and from distributing the software and/or documentation with other products without prior written permission from Boulevard.

DISCLAIMER OF WARRANTY

THIS SOFTWARE AND THE ACCOMPANYING FILES ARE "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OF MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED.  Boulevard will not be held liable for any damage to your computer system or data files, loss or disruption of business or for any actions brought against you for using this software.  The user must assume the entire risk of using this software.

DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

a.	YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. BOULEVARD EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF   MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
b.	BOULEVARD MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WIL
c.	ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
d.	NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM BOULEVARD OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.

 

LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT BOULEVARD SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER  INTANGIBLE LOSSES (EVEN IF BOULEVARD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM :

(i)	THE USE OR THE INABILITY TO USE THE SERVICE;
(ii)	THE COST OF   PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE;
(iii)	UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
(iv)	STATEMENTS OR  CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR
(v)	ANY OTHER MATTER RELATING TO THE SERVICE

NDEMNITY

You agree to indemnify and hold Boulevard, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post to or transmit through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.

WE RESERVE THE RIGHT TO DISCONTINUE SERVICE

You agree that Boulevard, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service for any reason, including, without limitation, if Boulevard believes that you have violated or acted inconsistently with the letter or spirit of the TOS. Boulevard may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this TOS may be effected without prior notice, and acknowledge  and agree that Boulevard may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that Boulevard shall not be liable to you or any third party for any termination of your access to the Service.
 

DEALINGS WITH ADVERTISERS AND PARTNERS

Your correspondence or business dealings with, or participation in promotions of, advertisers and partners found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or   representations associated with such dealings, are solely between you and such advertiser. You agree that Boulevard shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

BOULEVARD'S PROPRIETARY RIGHTS

You acknowledge and agree that the Service and any necessary software used in connection with the Service ("Software") contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the Service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by Boulevard or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part.
